POSITION SUMMARY: The Legal Counsel, Privacy & Compliance, will be responsible for managing and maintaining the implementation of PVHs North and South America, Latin America data privacy programs (CCPA and LGPD), including providing guidance on initiatives and projects with data privacy implications, creating and supplying materials for associate training and awareness, identifying best practices and data privacy principles for the Company, and partnering with the business to address changes in the shifting privacy landscape. This position will support PVHs various business segments on a broad range of commercial transactions, with a heavy emphasis on identifying and proactively addressing privacy issues, in close collaboration with the Legal Director, Global Privacy based in our European headquarters in Amsterdam. As time permits, it may also support other key compliance program initiatives, including anti-bribery and economic sanctions laws, regulations and risk assessments, as well as advising on and supporting third party due diligence. The ideal candidate will have extensive knowledge of current and emerging US privacy laws and experience negotiating a variety of commercial contracts from a data privacy perspective.

PRIMARY RESPONSIBILITIES WILL DEPEND ON CANDIDATE BUT MAY INCLUDE:

Working closely with the Legal Director, Global Privacy to advise on compliance across all aspects of the Americas data privacy laws and regulations (e.g., CCPA, LGPD), including data protection, data retention, data security, data breach rules, consumer-facing disclaimers and notifications, website privacy policies, ensuring consistent application of data privacy policies, practices and PVH privacy programs and guidelines.

Providing privacy guidance for PVH initiatives that involve vendor, consumer and associate information, including advising on privacys cutting-edge retail and marketing initiatives;

Supporting the development of, and maintaining as required, PVHs privacy programs and its related documentation.

Developing and providing online and in-person data privacy trainings;

Managing the companys Data Privacy Champion program globally with the Information Security Group, including providing training and guidance; working with the Legal Director, Global Privacy in Amsterdam to develop appropriate compliance program documentation, and working with the Legal Director, Global Privacy and Data Privacy Champions to track PVHs data privacy posture, as well as relevant regulatory developments around the world;

Reviewing and advising on privacy provisions for contracts and other commercial agreements;

Working closely with Legal and the Information Security Group teams, supporting as needed PVHs information security incident response process and supporting the investigation of potential privacy incidents, complaints or breaches in the Americas, including notifications and other resolution efforts

Assisting Internal Audit with internal and external privacy-related audits.

Assisting the Information Security Group, Compliance and Legal teams in managing third party due diligence processes and screening of vendors that pose data privacy risks;

As time permits, assisting the Vice President & Associate General Counsel, Global Compliance with other key components of PVHs global compliance program, including but not limited to managing its anti-bribery and economic sanctions compliance initiatives and various compliance risk assessments.

Take initiative to stay abreast on current and emerging privacy laws and regulations around the globe;

Demonstrate flexibility and willingness to work on a broad range of compliance matters

Possess excellent collaboration skills, managing multiple projects and tasks simultaneously across various functions, and on a deadline;

Exercise discretion and maintain confidentiality of sensitive information

Have exceptional interpersonal skills, a team player attitude, and a commitment to professionalism and collegiality.

ENVIRONMENT: This associate will work closely with the Legal/Compliance team to develop and oversee many of the procedures and processes required to ensure that the Company complies with its data privacy obligations in North and South America and Latin America. The position also offers the opportunity to work on emerging privacy issues globally and to travel to offices in North and South America to conduct trainings and manage projects.

EDUCATION: Undergraduate degree required. JD, Masters in Compliance or a related field required.

QUALIFICATIONS & EXPERIENCE: 3-6 years compliance experience at a law firm, corporation, consulting or accounting firm, with a focus on privacy. Experience with CCPA, LGPD and GDPR data privacy regulation. IAPP Privacy Certification (e.g., CIPP or CIPM) preferred. Additional language capabilities are a plus. Experience with privacy issues facing retailers preferred. Experience with developing and implementing a general privacy compliance program and working with first-party data sets preferred.
